How the compensation is calculated
Compensation equals the rent of an apartment of similar size and location, times a multiplier that depends on the month of delay. Which version applies depends on when the contract was signed.
Contract signed on or after 7.7.2022
- First month of delay: no compensation.
- Months 2 to 4: full rent (×1).
- Months 5 to 10: ×1.25.
- From month 11: ×1.5.
Contract signed before 7.7.2022
- Delay of up to 60 days: no compensation.
- Delay of more than 60 days: compensation runs from the contractual date itself.
- Months 1 to 8: ×1.5.
- From month 9: ×1.25.
Good to know
- In both versions a part of a month counts as a full month, and compensation is payable at the end of each month for that month.
- If the contract sets a higher agreed compensation, you are entitled to the higher amount. The law cannot be waived to the buyer's detriment.
- For contracts signed from 7.7.2022, the developer is exempt only if the delay was caused solely by the buyer, or by frustrating circumstances under section 18(a) of the Contracts (Remedies) Law. Earlier contracts could exempt circumstances outside the seller's control. The developer has to prove such circumstances.
- A contract clause letting the developer push back the handover without setting a clear new date may be treated as an exemption clause with no effect.
- The calculator does not include linkage, interest or amounts already paid, and does not fit very old contracts signed before Amendment 5 of the law (2011).
